20. Breach this Agreement, the SSOID Agreement or any other agreement or policy as may be applicable pursuant to the T&Cs;
21. Provide false, inaccurate or misleading information;
22. Use the Nammapayments.in Platform to collect or obtain personal information, including without limitation, financial information, about other users of the Nammapayments.in Platform, except and only as expressly provided in the T&Cs;
23. Avail Nammapayments.in Services with what Nammapayments.in reasonably believes to be potentially fraudulent funds;
24. Use the Nammapayments.in Services in a manner that results in or may result in complaints, disputes, reversals, chargebacks, fees, fines, penalties and other liability to Nammapayments.in, a third party or User;
25. Use the Nammapayments.in Services in a manner that Nammapayments.in or any payment card network reasonably believe to be an abuse of the payment card system or a violation of payment card network rules;
26. Send automated request of any kind to the Nammapayments.in Platform without express permission in advance from Nammapayments.in.

Information Collected Nammapayments.in will only collect, store, use, and share Your personal information (including email address) as it is defined by our Privacy Policy and as regulated by Indian laws.

a) It is being accepted by the User that the contact information is collected and used by the company to provide services opted for, which is provided by the User from time to time on Website. b) There is certain information which maybe tracked automatically by the Company/Website about the User like User’s IP address and User’s behavior on Website. The User authorizes the Website/Company to remove any such content, review, survey or feedback from Website which has been submitted by User, without cause or being required to notify the User of the same.

User Account/Data Deletion and De-Activate/Re-Activate A request to delete of user's account will not be entertained as we are bound to keep the customer's data and transaction history as per RBI Guidelines. A user can raise a request for De-Activation of his/her account by mailing us at support@Nammapayments.in from the registered email ID. After we receive the request, our team will take up to 72 working hours to De-Activate the account after which the user shall not be able to use any of our platforms (Website/Application). To Re-Activate the account, the user needs to email us at support@Nammapayments.in from the registered email ID. Once our team evaluates the authenticity of the request then only shall the account be Re-Activated.

Fees Payment Nammapayments.in reserves the right to charge listing fees for certain listings, as well as transaction fees based on certain completed transactions using the services. Nammapayments.in further reserves the right to alter any and all fees from time to time, without notice.

The User shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the services.
In case, there is a short charging by Nammapayments.in for listing, services or transaction fee or any other fee or service because of any technical or other reason, it reserves the right to deduct/charge/claim the balance subsequent to the transaction at its own discretion.
Any increase in the price charged by Company on account of change in rate of taxes or imposition of new taxes by Government shall have to be borne by customer.
In the rare possibilities of the reservation not getting confirmed for any reason whatsoever, we will process the refund and intimate User of the same. Namma Payments is not under any obligation to make another booking in lieu of or to compensate/ replace the unconfirmed one. All subsequent further bookings will be treated as new transactions with no reference to the earlier unconfirmed reservation.
The User shall request Namma Payments for any refunds against the unutilized or 'no show' air or hotel booking for any reasons within 90 days from the date of departure for the air ticket and/or the date of check in for the hotel booking. Any applicable refunds would accordingly be processed as per the defined policies of Airlines, hotels and Namma Payments as the case may be. No refund would be payable for any requests made after the expiry of 90 days as above and all unclaimed amounts for such unutilized or 'no show' air or hotel booking shall be deemed to have been forfeited.

Usage Of Mobile Number Nammapayments.in may send booking confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction, via SMS or by voice call on the contact number given by the User at the time of booking; Nammapayments.in may also contact the User by voice call, SMS or email in case the User couldn’t or hasn’t concluded the booking, for any reason what so ever, to know the preference of the User for concluding the booking and also to help the User for the same. The User hereby unconditionally consents that such communications via SMS and/ or voice call by Nammapayments.in is (a) upon the request and authorization of the User, (b) ‘transactional’ and not an ‘unsolicited commercial communication’ as per the guidelines of Telecom Regulation Authority of India (TRAI) and (c) in compliance with the relevant guidelines of TRAI or such other authority in India and abroad. The User will indemnify Nammapayments.in against all types of losses and damages incurred by Nammapayments.in due to any action taken by TRAI, Access Providers (as per TRAI regulations) or any other authority due to any erroneous compliant raised by the User on Nammapayments.in with respect to the intimations mentioned above or due to a wrong number or email id being provided by the User for any reason whatsoever.

Onus Of The User Nammapayments.in is responsible only for the transactions that are done by the User through Nammapayments.in. Nammapayments.in will not be responsible for screening, censoring or otherwise controlling transactions, including whether the transaction is legal and valid as per the laws of the land of the User. The User warrants that they will abide by all such additional procedures and guidelines, as modified from time to time, in connection with the use of the services. The User further warrants that they will comply with all applicable laws and regulations regarding use of the services with respect to the jurisdiction concerned for each transaction. The User represent and confirm that the User is of legal age to enter into a binding contract and is not a person barred from availing the Services under the laws of India or other applicable law.

Credit Report I hereby appoint INDITAB ESOLUTIONS PRIVATE LIMITED and NEOKRED TECHNOLOGIES PVT LTD as my authorized agents/representatives for the collection of my Credit Information Report. I hereby give my free consent and authorize INDITAB ESOLUTIONS PRIVATE LIMITED and NEOKRED TECHNOLOGY PT LTD PRIVATE LTD. by providing my personal information to obtain my Credit Information Report and Credit Score from Experian Credit Information Services Pvt. Ltd. ('Experian) & CRIF High Mark Credit Information Services Pvt. Ltd. ('CRIF') for the purpose of risk assessment and credit underwriting and not for any other purpose.

Refund Policy All services rendered by the Company are provided on a non-refundable basis. This includes, but not limited to, setup fees, monthly fees, upgrade fees and professional services fees. Customer agrees not to charge back any payments via Credit Card/ Debit Card/ Net Banking/ Direct Transfer or any other form of payment for services rendered. In the event that a customer files a charge back or other payment dispute, they will be considered to be in violation of this agreement and may be subject to collection action.

Cancellation Policy The Customer agree that the booking made are subject to the cancellation policy set out on the booking page or as communicated to the customers in writing.

Insurance Unless explicitly provided by Nammapayments.in in any specific service or deliverable, obtaining sufficient insurance coverage is the obligation/option of the user and Nammapayments.in doesn't accept any claims arising out of such scenarios. Insurance, if any provided as a part of the service/ product by Nammapayments.in shall be as per the terms and conditions of the insuring company. The User shall contact the insurance company directly for any claims or disputes and Nammapayments.in shall not provide any express or implied undertakings for acceptance of the claims by the insurance company.

Force Majeure Circumstances Nammapayments.in shall have no liability to you for any interruption or delay in access to the Site irrespective of the cause. Force Majeure event shall be one when there is any cessation, interruption or delay in the performance of Nammapayments.in's obligations due to causes beyond its reasonable control, including but not limited to: technical, earthquake, flood, or other natural disaster, act of God, labour

The customers are advised to read and understand the privacy policy of Nammapayments.in on its website in accordance of which Nammapayments.in contacts, solicits the user or shares the user's information.

Without prejudice to the other remedies available to Nammapayments.in under this agreement, the TOS or under applicable law, Nammapayments.in may limit the user's activity, or end the user's listing, warn other users of the user's actions, immediately temporarily/indefinitely suspend or terminate the user's registration, and/or refuse to provide the user with access to the website if:
• The user is in breach of this agreement, the TOS and/or the documents it incorporates by reference;
• Nammapayments.in is unable to verify or authenticate any information provided by the user; or
• Nammapayments.in believes that the user's actions may infringe on any third party rights or breach any applicable law or otherwise result in any liability for the user, other users of the website and/or Nammapayments.in.
Nammapayments.in may at any time in its sole discretion reinstate suspended users. Once the user have been indefinitely suspended the user shall not register or attempt to register with Nammapayments.in or use the website in any manner whatsoever until such time that the user is reinstated by Nammapayments.in.

Right To Cancellation By Nammapayments.in In Case Of Invalid Infromation From User The User expressly undertakes to provide to Nammapayments.in only correct and valid information while requesting for any services under this agreement, and not to make any misrepresentation of facts at all. Any default on part of the User would vitiate this agreement and shall disentitle the User from availing the services from Nammapayments.in.
In case Nammapayments.in discovers or has reasons to believe at any time during or after receiving a request for services from the User that the request for services is either unauthorized or the information provided by the User or any of them is not correct or that any fact has been misrepresented by him, Nammapayments.in in its sole discretion shall have the unrestricted right to take any steps against the User(s), including cancellation of the bookings, etc. without any prior intimation to the User. In such an event, Nammapayments.in shall not be responsible or liable for any loss or damage that may be caused to the User or any of them as a consequence of such cancellation of booking or services.
The User unequivocally indemnifies Nammapayments.in of any such claim or liability and shall not hold Nammapayments.in responsible for any loss or damage arising out of measures taken by Nammapayments.in for safeguarding its own interest and that of its genuine customers. This would also include Nammapayments.in denying/cancelling any bookings on account of suspected fraud transactions.

Interpretation Number And Gender The terms and conditions herein shall apply equally to both the singular and plural form of the terms defined. Whenever the context may require, any pronoun shall include the corresponding masculine, feminine and neuter form. The words "include", "includes" and "including" shall be deemed to be followed by the phrase "without limitation". Unless the context otherwise requires, the terms "herein", "hereof", "hereto", 'hereunder" and words of similar import refer to this agreement as a whole.

Severability If any provision of this agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.

Headings The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of this agreement, terms and conditions, notices, or the right to use this website by the User contained herein or any other section or pages of Nammapayments.in Websites or its partner websites or any provision hereof in any manner whatsoever.

EDUCATION FEE TERMS & CONDITIONS i. Role: Any registered User of the Platform may choose to make Tuition Fee, School Fees, Education Fees, or College Fee through the payment gateway(s) authorized by Namma Payments. In this regard, the Users are asked to provide customary billing information such as name, and financial instrument information which shall include the bank account number, IFSC code of the Receiver, UPI ID of the Receiver, Name of the Receiver to whom the payment has to be made. Users may also be asked to provide a copy of the Fee Bill, Student ID Card pursuant to which such education fee payments are being made. The Users must provide accurate, current, and complete information while making the payment through the Platform/App and it shall be the User’s obligation to keep this information up-to-date at all times. The Users are solely responsible for the accuracy and completeness of the information provided by them and Namma Payments shall not be responsible for any loss suffered by the User as a result of any incorrect information, including payment information provided by the Users.
Except for Namma Payments’s limited role in processing the payments that registered Users authorize or initiate, Namma Payments is not involved in any underlying transaction between the User, any other User, any third person or any service providers. Namma Payments is not a bank and does not offer any banking or related services. Namma Payments may use the services of one or more third parties (each a "Processor") to provide the Service and process the User’s transactions. Further, Namma Payments does not guarantee payment on behalf of any registered User, other User or Processor and explicitly disclaims all liability for any act or omission of any User or Processor. Namma Payments is neither an agent of the lessor or lessee or any registered User. Namma Payments acts solely as an intermediary which facilitates payments between the registered Users making the payment and the intended third-party beneficiaries.
ii. Authorization: The User acknowledges that Namma Payments is authorized by the User to hold, receive and disburse funds in accordance with the User’s payment instructions provided through the Platform for the purposes of facilitating the transfer of monies to the intended beneficiary as specified by the User on the Platform . [The authorization given by the Users permits Namma Payments (a) to debit or credit the User’s balance, bank account, any credit card, debit card, or other payment cards or any other payment method that Namma Payments accepts] or (b) to process payment transactions that the Users authorize by generating an electronic funds transfer. [By instructing Namma Payments to pay another User, the Users authorize and order Namma Payments to make the payments (less any applicable fees or other amounts we may collect under this Agreement) to such user. Namma Payments may limit the recipient's ability to use or withdraw the committed funds for such period of time that Namma Payments has agreed to with the recipient.]
iii. Fees: The User agrees that they may be charged a service charge by Namma Payments for using the Platform to make education payments
iv. Transaction Limits: Namma Payments may delay, suspend or reject a transaction for any payment(s) for any reason, including without limitation if Namma Payments suspects that the transaction subjects it to financial or security risk or is unauthorized, fraudulent, suspicious, unlawful, in violation of the terms of this Agreement subject to dispute or otherwise unusual.
v. Fraud and restrictions: Namma Payments may ask for additional documents (like Fee Bill, Student ID Card, Sender’s PAN, and Sender’s Aadhar) where it deems necessary, including in case the transaction looks suspicious. [Namma Payments will refund the full amount (excluding the nominal processing fees collected by Namma Payments) without any deductions if Namma Payments determines it is not a valid education fee payment or if such payment is fraudulent. A valid education fee payment is one where there exists a legally valid Student ID Card and Fees Bill Issued by Education Institute/ Teacher between the institution and the Student/parent with the fee amount equivalent to what is being transferred on Namma Payments. A valid education fee payment is one where there exists a fee bill between the payer and the receiver.
vi. Liability: The Users agree not to hold Namma Payments responsible and/or liable for any issue or claim arising out of any dispute whatsoever between the User and the Processor and/or the User and the User’s bank or financial institution.
Additionally, please note that Namma Payments shall not be responsible for any additional fees or charges deducted by the Processors while processing payments in connection with the User’s transaction and Namma Payments disclaims all liability in this regard. Further, the Users may also be subject to additional terms and conditions imposed by such Processors and the Users should review these terms and conditions before authorizing any payments through the Processors.
vii. Chargebacks: The amount of a transaction may be charged back or reversed to the User (a "Chargeback") if the transaction (a) is disputed by the sender, (b) is reversed for any reason, (c) was not authorized or Namma Payments has reason to believe that the transaction was not authorized, or (d) is allegedly unlawful, suspicious, or in violation of the terms of this Agreement. The Users owe Namma Payments and will immediately pay Namma Payments the amount of any Chargeback and any associated fees, fines, or penalties assessed by Namma Payments’s Processor, processing financial institutions, or MasterCard, Visa, American Express, Discover, and other payment card networks, associations, or companies ("Networks"). The Users agree to assist Namma Payments when requested, at the User’s expense, to investigate any of the User’s transactions processed through the Service. For Chargebacks associated with cards, Namma Payments will work with the Users to contest the Chargeback with the Network or issuing banks should the User choose to contest the Chargeback. In this regard, Namma Payments will request necessary information from the User to contest the Chargeback and the User’s failure to timely assist Namma Payments in investigating a transaction, including without limitation providing necessary documentation within 3 business days of Namma Payments’s request, may result in an irreversible Chargeback.
viii. Refunds: [In case, Namma Payments is not able to facilitate the transfer of the education fee amount to the beneficiary account due to any technical difficulties, Namma Payments will refund the payment back to the source.] The Users are advised not to transfer the amount directly to the beneficiary until a refund ID is generated and sent to the Users through email or SMS.
ix. The Users acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of the User’s access to and use of the payment Services remains with the Users. If the Users permit or authorize another person to use their Namma Payments account in any way, the Users shall be responsible for the actions taken by that person. Neither Namma Payments nor any other party or Processor involved in creating, producing, or delivering the payment Services will be liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any
damages for personal or bodily injury or emotional distress arising out of or in connection with these payments terms.
